With the combination of sufficient evidence obtained in the criminal case investigated by the RA Special Investigation Service, it was substantiated that A. D. senior investigator of Gugark division of community police unit of Lori marz Department of the RA Police received bribes from residents who had illegally cut trees, and abused his official authorities, in order to cover up the illegal deforestation in Lori marz, and one of the citizens who bribed a police officer also made a false delation.
In particular, a resident of Lori marz H. H. becoming informed that materials on the case of illegal cutting of one cubic meter of beech and hornbeam timber in November 2019, in which he was involved, were being prepared in the Gugark Division of the RA Police, told the same to his friend A. S. In order to help H.H. the latter met with officials of the Gugark division of the RA Police including senior inspector A.D.
Based on his personal interest in helping H.H., the close of his acquaintance A. S. the senior inspector of the Police distorted the real circumstances of the case during the process of preparation of the materials, conducted formal examination in another place, where H. H. did not actually cut the trees, hid the fact that the latter had illegally cut the beech timber, and made a decision on declining to initiate a criminal case. Due to the above-mentioned illegal actions of A. D. the damage caused to nature was reduced, and H. H. was subjected to an administrative fine of AMD 14,850 only. Then A. S. prompted H. H. to give a bribe to A. D., who personally received the bribe from him in Vanadzor city.
Besides, after stopping a car of another resident of Lori marz loaded with illegally cut timber by A.S., A.D. deliberately did not fulfill his official duties, but using his official position against the interests of the service demanded the latter and personally received a bribe in order not to proceed the illegal case of tree cutting and release A. S. from liability defined by law.
During the preliminary investigation, it was found out that A. S. made a false statement, unjustly accusing the police of torture and abuse of official authorities. The latter gave untrue testimonies to the RA Special Investigation Service that the officers of the General Department of the Criminal Police of the RA Police, allegedly tortured him, demanded that he confess to bribing a police officer, and then, under the influence of threats of violence he testified to be involved in illegal deforestation and bribed police officers.
The senior inspector of the Police A. D. was charged with article 308 (part 1) (2 episodes), and article 311 (part 2) (2 episodes) of the RA Criminal Code for committing the above-mentioned criminal acts. H. H. was charged with article 312 (part 1) of the RA Criminal Code, A.S., who inciting to give a bribe was charged with article 38-312 (part 1), and Lori marz resident A.S. was charged with article 312 (part 1) and article 333 (part 2, point 1) of the RA Criminal Code.
The preliminary investigation of the criminal case against the four accused is over. The criminal case was sent with an indictment to the supervising prosecutor with a motion to approve and send it to court.
Notification: a person that is suspected or accused of an alleged crime, is considered innocent until his/her guilt is proved by a court judgement that has come into legal effect pursuant to the procedure determined by RA Criminal Procedure Code.
