In response to journalists’ questions, after the publication of the decision made by the Supreme Judicial Council today on rejecting the petition of the RA Ministry of Justice to bring the judge of the RA Criminal Court of Appeal, Aleksandr Azaryan to disciplinary responsibility, Alexander Azaryan stated as follows:
“I am not the head of the SIS to give any assessment without being familiar with the decision”. We would not refer to the mentioned statement if A. Azaryan's behavior is not marked with repeated manifestations of intolerance and personal insults.
Thus, by behaving inappropriately during the interview with journalists on June 18, 2020 Azaryan stated that “Who is the head of the SIS to have a special attitude towards me?” The Special Investigation Service of the Republic of Armenia refrained from responding to this incorrect, moreover incompliant with the basic rules of ethics expression of the judge, expecting that the mentioned issue will be resolved through legal tools, an objective legal assessment will be given by the competent body. As a result, the judge Aleksandr Azaryan was not subjected to disciplinary responsibility in the terms of presence, in our opinion, of clear grounds that the Supreme Judicial Council should have subjected him to disciplinary responsibility, and this, in turn, created an additional favorable atmosphere for the mentioned subject to continue misconduct. In the end, the impunity encouraged Azaryan so much that after today’s sitting of the SJC, the latter did not refrain from using typical to him word products, which questioned the judge’s politeness.
Taking into account the above, we call on judge Aleksandr Azaryan to show maximum balance, correctness and restraint when expressing an opinion on the RA Special Investigation Service and the head of the Service, because, as we have already mentioned before, an unbalanced, unrestrained judge is dangerous for the justice.
Taking all this into account, we hope that Azaryan’s statements will be properly assessed by the Ethics and Disciplinary Committee of the General Assembly of Judges of the Republic of Armenia, as his behavior gives grounds to conclude that the latter’s violation of the judge's code of conduct has become regular, and the need to re-learn such rules is obvious.
