Preliminary investigation on criminal case with regard to the Judge Davit Grigoryan, is over

By the combination of sufficient evidence obtained during the preliminary investigation of a criminal case investigated in the RA Special Investigation Service, it was justified that Davit Grigoryan, the Judge of General Jurisdiction Court of Yerevan city, RA committed official frauds with the assistance of Gor Vardanyan, secretary of court sittings  held in the same court, where they discussed judicial cases. 

Particularly, the General Jurisdiction Court of Yerevan city received a complaint of a citizen against decisions of the investigator and the prosecutor on 07/09/2018, the criminal case on which was inscribed to the Judge Davit Grigoryan. Being obliged to start the examination of the complaint within 10 days upon its receipt, the latter fabricated protocol on court session dated 14.09.2018 with the assistance of secretary of court sittings  Gor Vardanyan, in order to show the start of the examination of the complaint within the set period creating an illusion of maintaining the procedural deadlines, with the personal motives of avoiding possible legal impact in future due to official failure. The protocol contained obviously false information that the plaintiff , representatives of the RA Investigation committee and the prosecutor’s office allegedly didn’t appear the court session, on which the court had no information, for which reason the court session was postponed and rescheduled.  

The formal unsigned summons on appearing to the court session to be held on 14.09.2018 with no outgoing dates, not registered in the court office, were enclosed to the materials of the abovementioned complaint. After fabricating the abovementioned protocol and affixing their signatures on it, D. Grigoryan and G. Vardanyan enclosed it to the materials of the case.

Besides, the General Jurisdiction court of Yerevan city received a petition of the head of Yerevan division of the Probation State Service of the RA MJ on 11/09/2018, the criminal case on which was inscribed to the Judge D. Grigoryan on the same day. The latter fabricated protocol on court session dated 14.09.2018 with the assistance of secretary of court sittings  G. Vardanyan, as a positive criteria of  efficient appraisal of his efforts, creating an illusion of maintaining the procedural deadlines, with the personal motives of avoiding possible legal impact in future due to official failure. The protocol contained obviously false information that the parties allegedly didn’t appear to the court session, on which the court had no information. For that reason, the court session was postponed and rescheduled.  

The formal unsigned summons on appearing to the court session to be held on 14.09.2018 with no outgoing dates, not registered in the court office, were enclosed to the materials of the abovementioned complaint. After fabricating the abovementioned protocol, which also contained false information and affixing their signatures on it, D. Grigoryan and G. Vardanyan enclosed it to the materials of the case. Moreover, it is noteworthy that in both protocols of court sittings  on the above mentioned criminal case dated September 14, 2018 the same time of the sittings was mentioned, while D. Grigoryan and G. Vardanyan were not present at the Avan residence of the Court of General Jurisdiction of Yerevan at that time.

The Judge Davit Grigoryan was charged with article 314 (part 1, 2 episodes) of the RA Criminal Code and the court settings secretary Gor Vardanyan was charged with 38-314 (part 1, 2 episodes) of the RA Criminal Code, for the commitment of the mentioned socially dangerous offence.

Preliminary investigation of criminal case with regard to Davit Grigoryan and  Gor Vardanyan is over. The case is handed to the prosecutor conducting control with the indictment to approve it and send to the court.

           

Notification: a person that is suspected or accused of an alleged crime, is considered innocent until his/her guilt is proved by a court judgement that has come into legal effect pursuant to the procedure determined by RA Criminal Procedure Code.
