On the basis of combination of sufficient evidence obtained during the preliminary investigation of the criminal case instituted in accordance with Article 309 (part 2) of the RA Criminal Code on the occasion of abuse of official powers along with violence by police officers of the Republic of Armenia, it was justified that in November 2008 the head of the criminal investigation unit of the Arabkir Division of Yerevan city Department of RA Police V. N. and senior criminal investigator of the same unit intentionally committed such actions in a group taken with violence and the use of special measures, which obviously were above their powers, and caused significant damage to the rights and the legitimate interests of the State.
Particularly, in the early November 2008 V. N. with the presence of the officers of the same unit, including the senior criminal investigator N. S., in his office talked to detained Armen Martirosyan on the subject of home burglary, with the suspicion to make the same. After denying the fact that the latter had anything to do with the case, V. N., N. S. and several other police officers, in order to continue the illegal actions for claiming to confess commitment of offence and achieve positive result, held Armen Martirosyan in the unit for a day, after which they took him to the office of the head of the unit, where claiming him to confess commitment of attempt to make a home burglary V. N. and N. S. with other officers, threw Armen Martirosyan to the ground punched him in the gas mask, and struck him with hands and hose to different parts of his body, causing physical pain.
For the commitment of the abovementioned criminal offences V. N. and N. S. were brought charge in accordance with article 309 (part 2) of the RA criminal code.
Preliminary investigation on the part of the criminal case separated on the abovementioned accused persons is over. The case was delivered to the prosecutor conducting control with a petition to approve and send to the court.
Notification: a person that is suspected or accused of an alleged crime, is considered innocent until his/her guilt is proved by a court judgement that has come into legal effect pursuant to the procedure determined by RA Criminal Procedure Code.
