On the basis of combination of sufficient evidence obtained during the preliminary investigation of the criminal case investigated in the Special Investigation Service of the Republic of Armenia with regard to the illegal collection and distribution of personal private information and abuse of official powers the head of appropriate unit of the RA National Security Service was charged with article 308 (part 1) of the RA Criminal Code, for abuse of official powers.
According to the charge on January 9, 2020 he asked by a relevant NSS officer to check the database for criminal records on Suren Papikyan, the RA Minister of Territorial Administration and Infrastructure, without any purpose set by the law and in the terms of absence of any legal grounds. At the request of the head of the NSS unit the abovementioned officer received the information from the RA Police Information Center operative directory and transmitted to the latter a statement on the conviction of Suren Papikyan, which contained personal private information, including inaccessible details of his conviction, the size of punishment, and other circumstances.
Thus, for personal reasons the above mentioned NSS official intentionally used his official position contrary to the interests of the service causing substantial damage to Suren Papikyan's rights and legitimate interests.
Recognizance not to leave was selected as a measure of restriction with regard to the accused. The investigator made a decision to temporarily suspend the office of the above-mentioned NSS official.
Preliminary investigation is underway.
Notification: a person that is suspected or accused of an alleged crime, is considered innocent until his/her guilt is proved by a court judgement that has come into legal effect pursuant to the procedure determined by RA Criminal Procedure Code.
