Cases of illegal sale of 106 hectare of land lots in a number of communities of Kotayk marz revealed

Abuses by Kotayk marz governor and the head of Hrazdan community, related with the auctioning process of lands in Hrazdan, Tsakhkadzor communities and  lands adjacent to Aghavnadzor, Artavaz, Arzakan communities,  have been revealed during the preliminary investigation of the criminal case investigated by the Special Investigation Service of the Republic of Armenia with regard to an article “Officials have privatized 60 hectare of forest in Tsakhkadzor” published on September 28, 2008 in “Hetk” online daily.  

Thus, it was found that by the resolution N 422-N of the RA Government dated April 5, 2007, the category of 55.88 hectare land beyond the administrative borders of communities within Kotayk marz territory and 50.48 hectare forest fund lands within the administrative borders of Hrazdan community was changed. A part of them was transferred to the category of specially maintained territories, and the other part to the settlement land categories for mixed construction.

The mentioned lands were obtained by different well-known persons, officials and their relatives by means of making false documents, without organizing actual auctions. 

Particularly, the lands in the mentioned territories have been obtained by Martun Matevosyan, who was within the discussed period holding the position of the director of the “Hayantar” SNCO, by Zarik Gevorgyan, the wife of Aram Danielyan the head of Hrazdan community,  Arsen Arzumanyan, the son of Levon Arzumanyan the counsellor of the head of the said community, Roman Galustyan, the head of  “Mshakuyt” SNCO of Charentsavan city, who was the friend to Kotayk marz governor Kavalenko Shahgaldyan, Armen Hovsepyan the son of Aghvan Hovsepyan, the RA Prosecutor General, Ishkhan Vardanyan, the brother of Aghvan Vardanyan the deputy of the National Assembly of RA, Shamrik Gabrielyan the wife of Harutyun Gharagyozyan, deputy of the National Assembly of RA, businessman Samvel Mayrapetyan, Grigor Gevorgyan, the driver of Hovik Abrahamyan the Minister of territorial Administration, and security officer Bagratuni Barseghyan, as well Nikita Abrahamyan, the uncle of boxer Artur Abraham.

Thus, during the preliminary investigation it was justified that former governor of Kotayk marz Kavalenko Shahgaldyan and the former head of Hrazdan community Aram Danielyan committed offences stipulated under article 308 (part 2)  of the RA Criminal Code, and  the members of auction commission established by them Levon Petrosyan, Manvel Petrosyan, Rudik Hovsepyan, Armine Verdyan and Myasnik Kostanyan committed offences under article 325 (part 2) of the RA Criminal Code. 

As a result of the actions of the mentioned officials 106 hectare lands have been illegally sold, thus causing significant loss to the state legal interests, and severe consequences by negligence. 

Taking into account the fact that time limits for criminal prosecution of cases described above have expired, in connection with which the aforementioned persons have applied to the proceeding authority with a request not to prosecute them on the above grounds, therefore the investigator of RA Special Investigative Service decided not to carry out criminal prosecution with regard to them and suspend the proceeding on the criminal case.

Copies of the decision have been sent to the RA Prosecutor General's Office to file a lawsuit seeking protection of state interests, as well as the RA Ministry of Territorial Administration and Infrastructure to void the administrative acts as prescribed by law and initiate the process of returning the aforementioned property to the Tsakhkadzor community and Kotayk municipality.

 

Notification: a person that is suspected or accused of an alleged crime, is considered innocent until his/her guilt is proved by a court judgement that has come into legal effect pursuant to the procedure determined by RA Criminal Procedure Code
