On May 23, 2014 on incident of keeping narcotic drug of “marihuana” type reaching large amounts without a purpose of realization under the unused trailer of the truck adjacent to the plot of land of Gabriel M. a criminal case was instituted pursuant to point 2, part 2, Article 268 of RA Criminal Code and for about 10 months preliminary investigation was carried out in RA Police Kotayk Marz Investigation Division.
Subsequently, conditioned by the factual circumstances of the case, starting from the necessity of guaranteeing multi-sided, complete and impartial investigation, the criminal case was sent to RA Special Investigation Service.
By the preliminary investigation it was ascertained that Shirak K. passing by the mentioned criminal case, didn’t master written Armenian language. Shirak K. informed that while taking explanation from him in the Police Division, the woman who was invited as a translator was under influence of alcohol and without providing a translation she signed the drawn up minutes and left. As a result the operative authorized official didn’t record correctly the circumstances stated by him, and no translator participated in all investigative actions carried out by the investigator, who was in charge of the criminal case. Besides, while representing a person for acknowledgement by a photo the identifying witnesses did not participate in the investigative action, but signed the minutes and went away.
By the materials of the mentioned criminal case, by features of part 1, Article 308 of RA Criminal Code on incident of abuse of official powers by officials a new criminal case was instituted.
