Preliminary investigation of the criminal case instituted on the fact of receiving a bribe of 20.000 US dollars by a judge is over

By the preliminary investigation of the criminal case examined at RA Special Investigation Service it has been ascertained and grounded that by a decision adopted on July 23, 2014 the judge of RA Lori Marz (region) General Jurisdiction Court Khachatur Khachatryan took to the proceedings the application on declaring involuntary bankruptcy of “Zosekar” LLC by the bank and on October 2, 2014 took a judgment on declaring the LLC bankrupt. By October 2, 2014 the debt of “Zosekar” LLC to the bank comprised about 517 thousand 940  US dollars, and the fulfillment of liabilities of the LLC was securedagainsta real estate mortgage. In November 2014 the judgedemanded a bribe of especially large amount – 10 thousand US dollars from the director of the mentioned LLC S. Karapetyan for taking actions in favourthe latter during the further process of bankruptcy within the scope of his authorities, as well as for postponing the process of sale by auction of the real estate mortgaged in the bank for securing the credit liabilities of the LLC till March 2015using theprestige and influence arising from his position, thus granting an opportunity to S.Karapetyan to acquire the mortgaged property. The director of the LL company agreed to the demand of receiving a bribe of especially large amount by the judge. At other meetings with the latter the judge Kh. Khachatryan increased the determined amount of the bribe and on December 20, 2014 demanded and on December 25, 2014, at about 6:30pm in his office of the mentioned court personally received from S.Karapetyan a bribe of especially large amount – 20 thousand US dollars, equivalent to 9 million 186 thousand RA drams, and immediately after it he was apprehended by NSS officers.

Note that the judge Khachatur Khachatryan has been charged pursuant to points 2 and 3, part 4, Article 311 of RA Criminal Code, and in the pre-trial proceedings detentionhas been chosen towards the latteras a measure of restraint.
The preliminary investigation of the criminal case in RA Special Investigation Service is over and the case with the indictment is submitted to the prosecutor carrying out procedural supervision to verify and send to the court.

Note: The suspect or the accused of the alleged offence is deemed innocent unless his or her innocence is proved by virtue of the effective court verdict in the manner prescribed by the Criminal Procedure Code of the Republic of Armenia.
