During the preliminary investigation of the criminal case instituted in RA Special Investigation Service pursuant to part 2, Article 309 of RA Criminal Code on the incident of seeming exceeding ofofficial powers combined with violence by persons carrying out special state service, Varditer Shaboyan, being warned about the responsibility stipulated by Article 333 of RA Criminal Code for making a false denunciationand being conscious that the information provided by her was false, unjustlyaccused the officials of RA Police ofexceeding their official powers. In particular, on July 10, 2014 V.Shaboyan submitted a written communication to RA Special Investigation Service stating that on May 08, 2014, after bringing H. Shamamyan to RA Police division on suspicion of theft,at 08:00am, two officials of the mentioned division ab invitoaccompanied her to the division too, where she was unlawfully kept till 7:00pm. During her being in the division, at about1:00pm, she allegedly heard sounds of curses addressed to H.Shamamyan by the police officials and of violence used towards him.
Notwithstanding V. Shaboyan’s communication, the circumstance of consciously providing false information by the latter has been grounded by the preliminary investigation. Firstly on the indicated day Hamlet Shamamyan was brought to the police division not at 8:00am but at 5:30pm, and VarditerShaboyan – on the same day at about 6:00pm, thus her allegations on hearing sounds of violence and curses towards H.Shamamyan at 1:00pm are false.
Besides, on the mentioned day at 6:00pm V.Shamamyan was in the criminal investigationsubdivision of the division, whereas H. Shamamyan was detained in the office of the investigator of the investigation subdivision, which are significantly far from each other, are located in different buildings, consequently these sounds could not have been audible for her.
At the same time, by testimonies of the witnesses and other undeniable proofs acquired by examination, the circumstance of V. Shaboyan’s being kept in the division for a lasting period of time – from 08:00 am till 7:00pm, has been denied.
The preliminary investigation of the criminal case in RA Special Investigation Service is over and the case with the indictment is submitted to the prosecutor carrying out the procedural supervision to be verified and sent to the court.
Note: The suspect or the accused of the alleged offence is deemed innocent unless his or her innocence is proved by virtue of the effective court verdict in the manner prescribed by the Criminal Procedure Code of the Republic of Armenia.
