The Special Investigation Service has finished the preliminary investigation of a criminal case initiated according to the RA Criminal Code, Article 375, part 1 and Article 38-375, part 1.
Preliminary investigation has revealed that Vahan Hovhannisyan, investigator for especially important cases of the Investigation Service of the RA Ministry of Defense, didn’t dismiss the criminal case in his proceeding in spite of having obtained by preliminary investigation evidence of an absence of corpus delicti in Armen. A.’s act (the latter serves as an officer in the Armed Forces of the Republic of Armenia). Instead, Vahan Hovhannisyan, driven by mercenary incentives, persuaded Armen A. into using the services of lawyer Azat A. (an acquaintance of Vahan Hovhannisyan’s) for the purpose of involving the latter in the pretrial stage of the criminal proceedings and getting share in the lawyer’s fee paid by the client.
Preliminary investigation has substantiated the fact that Armen A. paid 200 000 AMD for the lawyer’s services, out of which 55 000 AMD was given to investigator Vahan Hovhannisyan.
Hence, investigator for especially important cases Vahan Hovhannisyan abused his official position with mercenary incentives thus causing serious damage which manifested itself in the violation of Armen A.’s right to a fair trial as well as in the deprivation of the RA Ministry of Defense Investigation Service’s good name. Vahan Hovhannisyan has been charged according to the RA Criminal Code, Article 375, part 1.
Azat A. has been charged according to the RA Criminal Code, Article 38-375, part 1 for assisting Vahan Hovhannisyan in abusing his official position with mercenary incentives, which resulted in serious damage.
Having completed the preliminary investigation, the SIS investigator has submitted the criminal case with the bill of indictment to the prosecutor supervising the proceedings to be confirmed and sent to court.
