 CHARTER OF “THE STAFF OF SPECIAL INVESTIGATION SERVICE OF THE REPUBLIC OF ARMENIA” 

STATE ADMINISTRATIVE INSTITUTION 

 

I. GENERAL PROVISIONS

1. The Special Investigation Service of the Republic of Armenia (hereinafter Service) consists of the Head of Special Investigation Service (hereinafter Head of Service), Deputy Head, investigators and the Staff.
2. The Staff of Special Investigation Service of the Republic of Armenia (hereinafter Staff) is a state administrative institution, which does not have a status of legal entity, provides the complete and efficient exercising of powers of the Service, vested by the Constitution of the Republic of Armenia, international contracts, laws and other legal acts, and its participation in civil legal relations.
3. The founder of the Staff is the Republic of Armenia in the name of the Government of the Republic of Armenia. The Staff is reorganized and terminates its activity by the decision of the founder.
4. The Staff is subject to registration by the body conducting registration of legal entities by the order established by the Legislation of the Republic of Armenia.
5. The legal state of the Staff and the order of its activity are established by the Laws of the Republic of Armenia, this Charter and other legal acts.
6. The Staff has a separate balance, attached property and within its authority may acquire and implement property and private non-property rights on behalf of the Republic of Armenia, assume duties, appear in the court as a plaintiff or a respondent.
7. The Staff may not implement entrepreneurial activity. For the functions implemented and services provided by the Staff, only state duty may be exacted by the amount and order established by Law.
8. The Republic of Armenia is liable for the obligations of the Staff.
9. The full name of the Staff is:

Russian: “Аппарат специальной следственной службы Республики Армения” государственное управленческое учреждение.
English: “Staff of Special Investigation Service of the Republic of Armenia” state administrative institution. 
10. The location of the Staff is: 5 Vazgen Sargsyan, Yerevan city, 0010, Republic of Armenia.

II. MAIN TASKS AND FUNCTIONS OF THE STAFF

11. The main task of the Staff is to provide the complete and efficient exercising of powers vested to the Special Investigation Service of the Republic of Armenia, its participation in civil legal relations.
12. For the implementation of its tasks, by the officials of its structural subdivisions, the Staff
1) performs the functions that provide the exercising of powers vested to the Service by the Constitution and Laws of the Republic of Armenia,
2) performs functions related to the provision of financial budgetary, logistics and economic maintenance of the Service and Staff, organizational, technical maintenance, internal audit, administration of state property, acquisition of necessary items, works and services, state procurement, implementation of personnel policy of public servants and persons implementing the technical maintenance in the Staff, and other types of functions directed to the efficient activity of the Service and creation of necessary labor conditions for the employees,
3) performs functions related to the preparation of conferences, discussions, meetings, visits and trips, held during the activity of the Service, as well as preparatory functions of organizational technical nature of the sessions of Competition Committees,
4) provides representative ceremonies of the Service,
5) implements corresponding works envisaged by international contracts, in order to maintain collaboration of the Service with foreign investigation bodies and their officials, international organizations and their representatives, as well as the provision of procedures, referring to foreign relations of the Service and the Staff,
6) performs functions related to the relation of the Service with mass media and the public, preparation of press conferences and interviews,
7) performs functions related to the organization of common archiving of the Service,
8) provides the maintenance of the law archive and other legal acts of the Republic of Armenia, prepares chronological samples of appropriate legal acts, registers the legal acts adopted by the Head of the Service and Head of the Staff,
9) provides the introduction and exploitation of modern administration technical devices, computer programs, electronic communication means, local network, international information systems, means of availability in the Service and the Staff,
10) provides the unity of clerical work, circulation of electronic documents, archiving and keeping of electronic documents, arisen during electronic clerical work and its activity,
11) provides the operation, renovation, current construction of administrative buildings and adjacent areas of the Service,
12) exercises other powers vested to the Staff by legal acts.

III. ADMINISTRATION AND MANAGEMENT OF THE STAFF

13. The Staff is administered by the Government of the Republic of Armenia and by the Head of Special Investigation Service of the Republic of Armenia,
14. The Government of the Republic of Armenia
1) creates, reorganizes and terminates the activity of the Staff,
2) approves the Charter of the Staff and the amendments and addendums made therein,
3) determines the composition and size of the property transferred to the Staff,
4) exercises other powers vested to it by the Constitution and Laws of the Republic of Armenia.
15. Head of the Service 15. The Head of Service
1) approves and amends the structure of the Staff and the staff list,
2) approves and amends the list of positions’ names and the number of the staff of the public service (hereinafter public service) in the Staff of the Service,
3) approves passports of position of public service,
4) submits a motion to the President of the Republic of Armenia on conferring class degrees of highest counsellor to public servants (hereinafter public servants) in the Staff,
5) establishes
a. directions and order of the activity of press secretary, assistant to the Head of the Service and structural subdivisions,
b. the order of formation of Competition Committees for filling the vacant positions of public service and the working procedure,
c. the order of the competition held for filling a vacant position in public service,
d. the order of making up competition tests for filling a vacant position in public service and the system of testing,
e. the order of attestation of public servants,
f. the order of retraining of public servants,
g. the order of the activity of Staff subdivisions,
h. the order of keeping personal files of public servants,
i. the salary rates of public service posts in the Staff of the Service, according to their positions, as well other staff within the salary fund envisaged for each year by RA State Budget,
6) the main directions and functions of the Staff activity in accordance with the tasks of the Staff,
7) appoints and dismisses the Head, the Deputy Head of the Staff, Heads of structural subdivisions of the Staff, his/her assistant and press secretary,
8) applies encouragement to public servants, appointed by him/her or imposes disciplinary punishments on them by the order established by the Legislation of the Republic of Armenia,
9) suspends or declares void the legal acts of the Head of the Staff that contradicts the requirements of legal acts,
10) implements supervision over the maintenance of state property, attached to the Staff or transferred for its use,
11) hears the reports on the activity of the Staff, discusses the results of checking their activity,
12) exercises other powers established by the Laws of the Republic of Armenia, this Charter and other legal acts.
16. The direct management of the Staff is implemented by the Head of the Staff. The powers of the Head of the Staff are established by the Laws of the Republic of Armenia, by this Charter and by other legal acts.
17. The Head of the Staff manages the current activity of the Staff within his/her powers vested by law, other legal acts, orders of Service Head, this Charter, and is liable for not meeting the requirements of the laws, other legal acts, orders of the Government of the Republic of Armenia and the Head of the Service, this Charter or not meeting them duly.
18. The Head of the Staff is liable for the damaged property, caused to the State through his/her fault, by the order established by law. Termination of powers of the Staff Head is not a base for not performing duties to compensate for the material damage.
19. The Head of the Staff is liable not to implement the decisions, commands, orders and directions of the founder, that contradict the Legislation of the Republic of Armenia.
20. In case of the absence of the Head of the Staff, he/she is replaced by one of his/her Deputies by the order of Head of Service.
21. The Head of the Staff is a public servant in the Staff and is subordinate and accountable to the Head of Special Investigation Service of the Republic of Armenia.
22. The Head of the Staff 
1) provides the implementation of public service in the Staff,
2) submits a proposal to the Head of the Service, regarding the main directions and order of the activity of structural subdivisions of the Staff, in compliance with the sectors, goals, tasks of the activity of the Staff envisaged by law, other legal acts and the Charter,
3) provides the regular activity of the Staff, analyses the activity of the Staff periodically, implements the supervision of the current activity,
4) reveals the tasks subject to urgent solution, estimates opinions and drafts appropriate proposals based on them, issues orders within his/her powers, gives indications for compulsory fulfillment, supervises and checks up their fulfillment,
5) acts on behalf of the Republic of Armenia and of the Service without a power of attorney within his/her authority, presents their interests in the interrelations with other organizations and citizens, concludes contracts and transactions, appears in the court as a plaintiff or a respondent within his/her powers, gives powers of attorney to carry on the case in the court and carry out other procedural actions,
6) manages the state property attached to the Staff, including financial assets by the order established by law, other legal acts, Charter of the founder and the Staff,
7) gives powers of attorney to act on behalf of the Republic of Armenia and Service having the right to re-empower as well,
8) discusses the results of checking up the accordance of maintenance and use of the tangible assets assigned to competent public servants of the Staff, 
9) requires and receives necessary information and materials from state agencies and officials related to his/her authority,
10) manages the information arisen in the result of the activity of the Staff, provides information according to its importance by the order established by the law and other legal acts,
11) implements control over the meeting of the requirements established by law and other legal acts in the archive of Service,
12) appoints and dismisses public servants and employees conducting technical maintenance, encourages or imposes disciplinary punishments on them by the order established by law, except for the positions envisaged by sub-point 7 of point 15 of this Charter,
13) confers class degrees of public service except for the class degrees of highest counsellor,
14) submits the descriptions of passports of positions of public service officials, the list of the mentioned positions’ names and the number of the staff to the approval of the Head of the Service,
15) makes a decision on holding a competition for filling the vacant position of the public service, announces the competitions,
16) gives references about the vacant positions in public service, references according to which persons holding the positions meet the requirements established by legal acts,
17) submits proposals to the Head of the Service on encouraging relevant employees of the Staff and imposing disciplinary liabilities on them,
18) organizes the works of retraining and raising the qualification of the employees of the Staff by the established order,
19) provides the communication of the Staff with state governing and local self-governing and other bodies of the Republic of Armenia,
20) is the manager of financial assets of the Service, i.e. the chief financier, and exercises the powers vested to him/her by the Legislation,
21) regulates relations and tasks with the Treasury, arisen during the activity of the Staff,
22) provides works related to target use of allocated funds of budget year, settlement account, formation of documents for payment, banking transactions, formation of financial statements,
23) takes measures for the efficient use of the subsidies allocated to the Staff,
24) provides works for the development of medium-term expenditure program of the Service system and budget tender for the coming year,
25) implements analysis of budget performance, prepares tenders for funding, based on financial statements and analyses,
26) provides the development of proportional allocation scheme of funds allocated to the Staff from the budget,
27) provides financial budgetary discipline, supervises the settlement account of the Staff,
28) approves statements of financial, budgetary, tax, statistical, compulsory payments of the Staff,
29) provides and supervises the accounting of financial resources and material values by the established order and the inventory of functioning related to their further move,
30) submits cost estimate of Staff maintenance expenses to the approval of the Head of the Service,
31) provides the professional financial and economic expertise of the documents that should be submitted to the Head of the Service and are subject to be signed by him/her,
32) organizes preparatory works of tenders for funding from the budget by the Head of the Service, cost estimate of system maintenance expenditures,
33) provides presence of the management of financial flow and internal audit system in the Staff,
34) provides the assessment about meeting the requirements of the approved acts on financial issues in the Staff and state non-commercial organizations of the system, reveals non-compliances in settlement account records and corrects them,
35) provides the presence of the procurement system in compliance with the Legislation on Procurement,
36) receives and approves monthly statements about revenues and expenses of the Staff during the previous month by operating and economic classification of budget expenditure,
37) receives and approves projections of expected revenues and expenditures for the remaining period of the current fiscal year,
38)analyses and compares necessary reports received together with current reports from the subdivisions of the Staff, summarizes them and submits to the approval of the Head of the Service by the established order,
39) summarizes reports on the implementation of the measures and programs by the Service by revealing the reasons of digressing from the program,
40) provides the accounting of material values and monetary means confiscated by the Service, 
41) manages existing sums of deposit accounts of the Service by the order established by law,
42) organizes annual inventory in the Service, controls the target use of the property, terms of its use, as well as reallocates, writes off the rest property and other values,
43) organizes permit control in order to maintain the security of Service employees, exploitation and maintenance of administrative buildings and constructions,
44) organizes efficient exploitation and the regular operation of the creation of common network of computer, other means of communication, motor transport economy of the Service,
45) is responsible for the efficient administration of financial obligations and fixed assets of the Service and the Staff (including the registration, maintenance and operation of fixed assets), as well as for the prevention of waste of material and financial assets and contingencies, for their efficient use,
46) is responsible for the provision of funds allocated by budget to the state institutions of the system, in compliance with budget category and for the supervision over the target use of those funds by them,
47) is responsible for the provision of collection of funds by the Staff in cases and by the order envisaged by the Legislation,
48) provides the unity of clerical work in the Service,
49) exercises other powers related to the activity of the Staff, established by law and other legal acts.
23. The Head of the Staff has a Deputy, who acts directly under his/her subordination and implements organization and systematization of works in the sectors assigned to him/her.
24. The Deputy Head of the Staff is a public servant who is appointed to the position by the Head of the Service.
25. The powers of the Deputy Head of the Staff are established by this Charter, the passport of position and by other legal acts.
26. In case of the absence of the Head of the Staff, the Deputy Head of the Staff performs the latter’s duties.
27. In case of simultaneous absence of both the Head and the Deputy Head of the Staff, the duties of the Head of the Staff may perform also another public servant, by the order of Head of Special Investigation Service of the Republic of Armenia.

IV. SETTLEMENT ACCOUNT AND STATEMENTS

28. The Staff of the Service keeps the settlement account by the order established by the Legislation of the Republic of Armenia and submits statements of financial, tax, compulsory payments and statistics, calculations, declarations to appropriate bodies.
29. Assurance of annual financial statements of the activity of the Staff of the Service may be audited (reviewed) by the order established by the Government of the Republic of Armenia.

V. PUBLIC SERVANTS AND EMPLOYEES 
CONDUCTING TECHNICAL MAINTENANCE OF THE STAFF

30. Public servants and the employees conducting technical maintenance of the Staff perform their functions in accordance with the Labor Code of the Republic of Armenia and other legal acts.
31. Official interrelations between public servants in the Staff are regulated by the Legislation of the Republic of Armenia and by this Charter.
32. The assistant to the Head of the Service and press secretary, employees conducting technical maintenance, as well as persons performing other tasks and functions on contractual basis are not considered public servants in the Staff.
33. Assistant to the Head of Special Investigation Service of the Republic of Armenia and the press secretary, as well as employees conducting technical maintenance are employees of the Staff. Their positions are included in the staff list of the Staff and relations with those positions are regulated by the Labor Code of the Republic of Armenia, this Charter and other legal acts.
34. Employees of the Staff that are not public servants, are employed and dismissed by the Head of the Staff, by the order established by the Labor Code of the Republic of Armenia.
35. Public servants and employees conducting technical maintenance of the Staff are accountable according to their superiority and each performs in compliance with his/her passport of position or powers.

VI. PROPERTY AND FUNDING OF THE STAFF

36. Property of the Staff is formed by the Government of the Republic of Armenia, by the order established by law, as well as the property (including property rights) obtained in the result of transactions executed by the Staff on behalf of the Republic of Armenia that is transferred (attached) to the management, possession and use of the Staff that is registered on its balance sheet. 
37. The Government of the Republic of Armenia has the right to take the property of the Staff at any time.
38. The Staff has the right to use, manage and possess its property, in accordance with the goals of its activity and significance of the property, in cases and by the order envisaged by law, other legal acts and its Charter.
39. Maintenance expenses of the Staff are completely funded by state budget. The Staff may also be funded by other financing sources not prohibited by law.
40. The Staff performs its financial functions and procurement for its needs by the order established by the Legislation of the Republic of Armenia, i.e. through treasury system.
41. The funding of the maintenance expenses of the Service and budget process are implemented by the Staff by centralized system. 
42. Procurement for the needs of the Staff is implemented by the Law of the Republic of Armenia on Procurement and by the order established by other legal acts.


VII. REORGANIZATION OF THE STAFF 
AND TERMINATION OF THE ACTIVITY

43. Reorganization of the Staff and termination of its activity is implemented by the order established by law.

The establishment of the “Staff of Special Investigation Service of the Republic of Armenia” state administrative institution and the approval of its Charter depend on the Laws of the Republic of Armenia on “Special Investigation Service” and “State Administrative Institutions”.
