By the combination of sufficient evidence obtained in the criminal case investigated by the RA Special Investigation Service it was substantiated that on April 29, 2020 at around 17:05 the Vice Speaker of the National Assembly of the Republic of Armenia Alen Simonyan noticing the leader of “Adekvad” party Artur Danielyan in the area of the park called “Malibu Park” in Yerevan greeted him, but the latter in order to emphasize his personal advantage at the persons around him, insulted the NA vice-speaker and his parents by swearing of sexual nature, where A. Simonyan, surprised with this behaviour, hit once with his forehead to A. Danielyan’s nose, thus causing slight injury to him, after which a scuffle broke out between them. At that time ignoring the fact that he was in a public place - crowded park in Yerevan city, in the presence of people having their leisure time in the area, A. Danielyan continued to deliberately violate public order by showing open contempt for the public with hooligan motives, gave sexual swearing to the representative of the RA legislative body, applied violence against him, hitting A. Simonyan’s head and other parts of the body causing bodily injuries.
Ignoring urgings of the citizens who approached to him to stop the fight A. Danielyan continued the hooligan actions, during which he hit the NA vice-speaker, then pursued A. Simonyan who was already leaving, and gave sexual insults to him.
Artur Danielyan was charged with committing the above-mentioned criminal act under article 258, part 2 of the RA Criminal Code.
During the preliminary investigation, it was found out that at the moment of hitting A. Danielyan, A. Simonyan was in a state of severe mental agitation, which was confirmed by the factual data obtained in the criminal case. In such conditions, on July 30, 2020 decision was made not to prosecute A. Simonyan, on the grounds of lack of guilt in his actions.
Considering the obtained evidence sufficient to draw up an indictment to send the case to court the body conducting the proceedings informed the victim and his representative, the accused and his lawyer, providing them with the materials of the criminal case.
Notification: a person that is suspected or accused of an alleged crime, is considered innocent until his/her guilt is proved by a court judgement that has come into legal effect pursuant to the procedure determined by RA Criminal Procedure Code.
