Taking into account the contradictory representations of the public and mass media with regard to suspension of proceeding on the criminal case investigated on incidents taken place in Sari Tagh in 2016 the RA Special Investigation Service deemed it necessary to inform that the proceeding on the criminal case was not terminated, but suspended, which doesn’t intend that investigative operations and intelligence measures on the criminal case have been stopped.
Particularly, according to article 258 (part 2) of the RA Criminal Procedural Code after suspension of the criminal proceedings the investigator, both personally and through the investigating body takes measures to reveal the person to be attracted as an accused or to reveal the place of the accused or to find the accused fleeing from investigation.
According to article 3 of the same article when necessary, the investigator can conduct appropriate investigatory actions.
When giving notice to the victims and their representatives on the suspension of the criminal case the investigator of the RA Special Investigation Service justified that intelligence measures and investigation operations taken with regard to revealing persons involved in the crime are going on. According to article 260 of the RA Criminal Procedural Code, upon the necessity suspended criminal proceeding can be resumed and procedural actions can be conducted, including without the participation of the accused.
It is worth mentioning once again that 9 persons, among which police officers have been brought charge on this criminal case for commitment of offences of different gravity. Judge of conviction on 8 of them has taken legal effect; proceeding on one is still goes on.
Investigative operations and intelligence measures for revealing other involved persons on this criminal case are still going on.
