The survey conducted in “Nubarashen” Criminal-Executive Institution of the Ministry of Justice of the Republic of Armenia by the employees of the Control Department over the Legitimacy of the Application of Punishments and Other Means of the General Prosecutor’s Office of the Republic of Armenia show that the prisoner of the above Criminal-Executive Institution carries his punishment in an open-zone and has the right to leave the territory of the Criminal-Executive Institution on working days between the period from 08:00 to 20:00.The prisoner provided a false reference to the Criminal-Executive Institution which, proved that he allegedly worked on working days in a limited liability company so as to take care of his social and economic needs. Thereafter, the prisoner entered into a contract with the above LLC, but was dismissed from his post for the reason of being absent from work and the Officer of State Special Service of the Criminal-Executive Institution in his turn did not check the work attendances within the periods as stipulated by the law. The prisoner has been absent from work for more than one year, but on basis of the false reference provided he freely left the territory of the Criminal-Executive Institution.
On basis of the decision of the General Prosecutor of the Republic of Armenia and in view of the need to ensure comprehensive, complete and objective examination conditioned by factual circumstances, the criminal case launched in accordance with Part 1 of Article 325 of the Criminal Code of the Republic of Armenia was sent to the Special Investigation Service of the Republic of Armenia which instituted proceeding against it.
A preliminary Investigation is underway.
