The Special Investigation Service of the Republic of Armenia has accomplished the preliminary investigation of the criminal case with regard to the cases of unlawful deprivation and attempted rape in accordance with Part1 of Article 133 and Part1 of Articles 34-138 of the Criminal Code of the Republic of Armenia.
The preliminary investigation revealed that on August 24, 2014 at about 3 AM the police officer of the Republic of Armenia Hayk B, being under the effect of alcohol, while driving the bus in Shengavit Administrative District of Yerevan city, which was the ownership of the Economic Department of the Police of the Republic of Armenia stopped it when he saw Yulia A. who stopped it with her hand. He agreed to take her to the third district of the above administrative district. On the way learning that she had arrived from another country and did not know Armenian and lost her way and in order to find out the reasons of her being outside at such a later hour, to specify his doubts as to her individually and behavior without an intention of abducting her he drove the car in different directions and did not allow Yulia A. to get off the bus. The police officer Hayk B. illegally detained for about four hours. He then attempted to have sexual intercourse with her against her will but the latter resisted and did not allow him to take off her clothes, she struck him with her leg and pushed the policeman aside and under such circumstances Hayk N. for the reasons beyond his control failed to accomplish the offence.
Note: The suspect or the accused of the alleged offence is deemed innocent unless his or her innocence is proved by virtue of the effective court verdict in the manner prescribed by the Criminal Procedure Code of the Republic of Armenia.
