A new criminal case has been launched based on the criminal case reviewed in the Special Investigation Service of the Republic of Armenia against the convicted accused of committing a robbery attempt Grigor V. in accordance with Part 1 of Article 315 of the Criminal Code of the Republic of Armenia and was taken as another proceeding since the materials to the case obviously show the signs of offence as to nonfulfillment or improper fulfillment of their duties as a consequence of unconscientious or negligent attitude towards the service by the officials of “Vardashen” Criminal-Executive Institution of the Ministry of Justice of the Republic of Armenia. The preliminary investigation of the criminal case reviewed in respect of Grigor V. accused of committing a robbery attempt revealed that on October 26, 2014 at about 23:40, at Tumanyan street, Yerevan, Grigor V. obviously attempted to steal a bag and a mobile phone from Yepraksia T. by committing violence undangereous to the latter’s health. Afterwards, he was caught on the spot when escaping by the individuals present nearby and did not accomplish the crime for the reasons regardless of his will. The preliminary investigation also indicated that Grigor V. was a prisoner carrying his punishment in the “open” zone of “Vardashen” Criminal-Executive Institution of the Ministry of Justice of the Republic of Armenia, who was allowed to leave the territory of the Criminal-Executive Institution only on working days from 8AM to 8PM, but the prisoner left the territory of the institution on a nonworking day and committed the above crime. In addition, the preliminary investigation yielded certain data about the fact that the mobile phones of the prisoner were also used outside the territory of the criminal-executive institution on other nonworking days, whereas on such days as a result of the inspection of the officers on duty of the institution did not detect any violation or drawbacks. An arrest as a measure of restraint has been determined in respect of Grigor V. A preliminary investigation is underway.
